Terms of Service

By creating an account or using Growena, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use Growena. We may update these terms as described in section 12.

Growena is a gardening companion app: plant tracking, care reminders, journaling, and AI-assisted plant recommendations and photo analysis.

• You must be at least 16 years old to use Growena.
• One account per person. The information you give us (name, email) must be accurate.
• You're responsible for keeping your password secure and for all activity under your account.
• Tell us right away at growena.deki@gmail.com if you suspect unauthorized access to your account.

When using Growena, you agree not to:

• Circumvent or abuse AI credit limits, upload limits, or other fair-use restrictions (e.g. automated/scripted requests)
• Scrape, reverse-engineer, or attempt to extract the plant catalog or other app data in bulk
• Upload photos or journal content that is illegal, infringes someone else's rights, or is harmful/abusive
• Impersonate another person or misrepresent your affiliation with anyone
• Interfere with or disrupt the service (e.g. attempting to bypass security, overloading our infrastructure)

Violating this section may result in suspension or termination of your account (see section 9).

Growena's AI features (plant recommendations, photo analysis, care advice) are provided for general guidance only and are not a guarantee of any outcome. Plant care depends on many factors outside our control — always use your own judgment.

Photos and journal entries you upload remain yours. We only use them to provide the service to you (e.g. AI photo analysis you request).

Growena is currently free to use during our beta period — we do not charge for any plan or process any payments today.

Since no payments are processed today, there is nothing to cancel or refund yet.

You can delete your account at any time in Settings → Danger zone. Deletion is scheduled 30 days out and can be cancelled during that window; after that, your data is permanently erased.

We may suspend or terminate your account if you violate section 4 (Acceptable use) or these terms more broadly. Where practical, we'll try to warn you first — except in cases of serious abuse, or where we're required to act immediately by law.

To the fullest extent permitted by law, Growena is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of Growena.

Our total liability for any claim arising from these terms or your use of Growena will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) €50.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law — for example, liability for death or personal injury caused by negligence, fraud, or other liability that the law does not allow us to limit.

TODO: legal review — confirm the €50 floor and the mandatory-rights carve-out match the final governing-law jurisdiction (see section 11), and check whether local consumer-protection law requires additional carve-outs.

These terms are governed by the laws of the Republic of Serbia, where Growena is currently operated from. This section will be revisited once a company is incorporated.

We may update these terms from time to time. If we make material changes, we'll notify you by email or an in-app notice before they take effect. Continuing to use Growena after changes take effect means you accept the updated terms; if you don't agree, you can delete your account (section 9).
